Entrepreneurs Cirque Media (“Company,” “we,” “us,” or “our”) values your privacy. 1. Acceptance of Terms
By purchasing, subscribing to, or accessing any digital product, membership, or feature through the Entrepreneurs Cirque Media (EC) website or affiliated platforms, you (“Customer,” “Member,” “Contributor,” or “You”) agree to be legally bound by these Digital Terms of Sale (“Agreement”).
This Agreement incorporates by reference EC’s Terms of Service, Contributor Guidelines, Editorial Policy, and Privacy Policy, all of which collectively govern your relationship with EC.
If you do not agree to these terms, you must not proceed with your purchase or use EC’s digital services.
2. Scope of Sale
These Terms apply to all digital and intangible services provided by EC, including but not limited to:
- Contributor memberships and subscription plans;
- One-off publishing features such as Business Spotlight, Entrepreneur Spotlight, and EC-100 listings;
- Digital magazine placements, sponsored content, or advertising services; and
- Any other digital goods, content access, or related services made available by EC.
All products and memberships sold by EC are digital in nature and are deemed delivered and fulfilled upon purchase or account activation.
3. Payment & Billing
- All fees must be paid in full at the time of purchase using EC’s authorized payment gateways (Stripe, PayPal, credit/debit card, or other approved processors).
- You authorize EC to process and retain payment information for recurring membership renewals or future authorized transactions.
- Prices are listed in United States Dollars (USD) unless otherwise specified.
- EC reserves the right to modify pricing or membership plans at any time, with notice provided before renewal dates for recurring subscribers.
4. Non-Refundable Policy
All sales are final and non-refundable due to the immediate and digital nature of EC’s products and services.
Refunds, cancellations, or chargebacks are strictly prohibited once digital access, publication, or feature placement has been granted.
Exceptions may be considered only in cases of verified duplicate billing or demonstrable technical error by EC.
By proceeding with a purchase, you expressly acknowledge and waive any right to dispute charges through chargeback or reversal with your payment provider once digital access is delivered.
5. Membership Access & Responsibilities
- EC memberships and contributor accounts are personal, non-transferable, and intended solely for individual or authorized business use.
- Members must comply with all EC editorial, contributor, and publishing guidelines.
- EC reserves the right to suspend or terminate access, without refund, if a member:
- Violates EC’s Terms of Service, Contributor Guidelines, or editorial ethics;
- Submits plagiarized, defamatory, or non-compliant content;
- Engages in conduct that damages EC’s reputation, brand, or operations.
6. Publication Rights & License
- Contributors and members retain authorship of their original content. However, by submitting any material to EC, you grant Masidas Enterprise LLC (DBA Entrepreneurs Cirque Media) a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, publish, modify, reproduce, distribute, and promote such content across EC’s platforms and affiliates.
- EC may archive, republish, or syndicate content at its sole discretion, without additional approval or compensation.
- Contributors waive any right to royalties, residuals, or future compensation associated with their published content unless otherwise agreed in writing.
7. Digital Feature Services
For paid editorial features or spotlights (e.g., Business Spotlight, Entrepreneur Spotlight, EC-100):
- All features are subject to editorial review and approval.
- EC reserves the right to edit submissions for clarity, tone, accuracy, or compliance without altering core meaning.
- Publication timelines and placement are determined solely by EC’s editorial calendar.
- EC does not guarantee external publicity, media coverage, or financial outcomes resulting from any feature.
8. Intellectual Property
All EC materials, branding, logos, trademarks, and content on the EC platform are the exclusive intellectual property of Masidas Enterprise LLC and are protected under U.S. and international copyright law.
Unauthorized reproduction, redistribution, or misuse of EC’s intellectual property is strictly prohibited and may result in legal action.
9. Limitation of Liability
To the fullest extent permitted by law, EC shall not be liable for any indirect, incidental, consequential, or punitive damages arising from or relating to any purchase, membership, or publication service.
In no event shall EC’s total liability exceed the amount paid by you for the specific product or service giving rise to the claim.
10. Governing Law & Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, USA, without regard to conflict of law principles.
All disputes, claims, or legal proceedings shall be brought exclusively before the state or federal courts located in Dallas County, Texas.
By entering this Agreement, you consent to the jurisdiction of those courts.
11. Modification of Terms
EC reserves the right to modify or update these Digital Terms of Sale at any time.
Any changes will take effect immediately upon posting to the EC website. Continued use or renewal of services constitutes acceptance of the revised Terms.
12. Entire Agreement
These Digital Terms of Sale, together with EC’s Terms of Service, Privacy Policy, and Contributor Guidelines, constitute the entire understanding between you and EC concerning digital purchases and supersede any prior written or oral agreements.
